Abstract

The article investigates all types of restrictions on doing business in Ukraine. The content of restrictions that exist in Ukraine is clarified. The main restrictions on entrepreneurship, which are reinforced by the relevant legislative acts of Ukraine, are summarized and arranged. Grouped restrictions are conditionally divided into several categories. The first category of restrictions is characterized, which is related to the state’s monopoly on a certain activity, which is the state’s exclusive right to such economic activity. The characteristic of the second category of restrictions is provided, which is related to the licensing of certain types of entrepreneurship activity. The third category of restrictions is summarized and explained, which is related to subjective restrictions (restrictions apply to state authorities, local self-government authorities; certain categories of citizens; restrictions on the joint work of close persons; restrictions for persons who have been forbidden by the court from engaging in certain activity). The fourth category of restrictions in performing entrepreneurial activity, related to special requirements, is investigated and substantiated: organizational and legal form; the size of the statutory fund. It was summarized: restrictions for business entities that operate on a simplified taxation system (regarding the type of activity, amount of annual income, number of employees); restrictions on the implementation of certain types of activity for individual entrepreneurs on the general taxation system. It was considered: restrictions on the volume of production and sale of goods by establishing quotas; restrictions on the sale, transportation, production and use of pyrotechnic products. The content of requirements regarding the introduced legal regime of martial law in Ukraine is defined. It was concluded that restrictions on the implementation of entrepreneurship activity are determined by state authorities and established exclusively by laws. According to the research results, it is proposed the grouping of restrictions on the implementation of entrepreneurial activity according to certain categories, which are reflected in the relevant legislative acts of Ukraine.
